IndustryNet Connect Terms of Service

IndustryNet Connect is intended for lawful, professional, business-to-business outreach. Users are solely responsible for the content, timing, frequency, targeting, and legality of all phone calls, emails, messages, and other communications made using or based on information accessed through IndustryNet Connect.

These IndustryNet Connect Terms of Service supplement the MNI Terms of Use, which are incorporated by reference. By subscribing to, accessing, or using IndustryNet Connect, you agree to both these IndustryNet Connect Terms of Service and the MNI Terms of Use. If there is a conflict between these IndustryNet Connect Terms of Service and the MNI Terms of Use, these IndustryNet Connect Terms of Service control solely with respect to use of IndustryNet Connect.

Emails sent through IndustryNet Connect are delivered one-to-one in plain text through IndustryNet mail servers using a contact form. Recipient email addresses are not disclosed unless the recipient chooses to respond. Messages are generally delivered to primary business inboxes such as info@, inquiries@, or other company-designated addresses. IndustryNet does not guarantee that any email will be delivered, opened, read, forwarded, or responded to, and does not guarantee any response rate, sales result, business opportunity, or other outcome.

All outreach must be professionally written, truthful, non-misleading, relevant to the recipient's company or industry, and provide a legitimate business purpose or measurable business value. Users may not use IndustryNet Connect to send unlawful, deceptive, misleading, harassing, offensive, irrelevant, or abusive communications.

Users are solely responsible for complying with all applicable federal, state, local, and international laws, rules, and regulations governing telephone, email, text, marketing, solicitation, privacy, data use, and commercial communications, including without limitation the CAN-SPAM Act, do-not-call rules, telemarketing laws, anti-spam laws, privacy laws, and any similar laws or regulations that may apply. Users are responsible for determining whether a company, phone number, email address, contact, or recipient may lawfully be contacted.

Users must not knowingly contact any company, phone number, email address, or recipient that has previously requested not to be contacted by the user, the user's company, or anyone acting on the user's behalf, whether that request was made through IndustryNet Connect, directly to the user, through another service, or by any other means. Users are solely responsible for maintaining and honoring their own internal do-not-call, do-not-email, suppression, unsubscribe, and do-not-contact lists.

All emails sent through IndustryNet Connect will include an opt-out link. Users must also honor any opt-out, unsubscribe, do-not-call, do-not-email, or similar request received outside of IndustryNet Connect. IndustryNet's inclusion of an opt-out link does not relieve users of their own legal obligations or responsibility to maintain their own suppression records.

All emails sent, including repeated outreach to the same supplier, count against the user's daily send limits. Phone number views, address views, website visits, LinkedIn profile views, and email sends are subject to the limits of the user's plan. Unused daily credits do not roll over. Availability of websites, LinkedIn profiles, email contact forms, phone numbers, addresses, and other listing information may vary by supplier and may change at any time.

IndustryNet reserves the right, but has no obligation, to monitor, review, limit, suspend, or terminate any account or message activity that IndustryNet determines, in its sole discretion, may be inappropriate, unsuitable, unlawful, abusive, excessive, misleading, likely to generate complaints, harmful to recipients, harmful to IndustryNet's systems or reputation, or otherwise inconsistent with these terms. Excessive opt-outs, spam complaints, recipient complaints, unusual usage patterns, or suspected abuse may result in account review, throttling, suspension, or termination.

The use of automated bots, scripts, agents, scraping tools, browser automation, outsourced manual harvesting, shared credentials, or any other method intended to bypass daily limits, automate outreach, extract data, harvest contact information, or create lists outside the ordinary use of IndustryNet Connect is strictly prohibited.

IndustryNet and MNI are not responsible for any claims, complaints, fines, penalties, damages, losses, costs, or expenses arising from or relating to a user's calls, emails, messages, solicitations, marketing activities, use of supplier information, failure to comply with applicable laws, failure to honor opt-outs or do-not-contact requests, or misuse of IndustryNet Connect. Users agree to indemnify, defend, and hold harmless MNI, IndustryNet, and their respective officers, directors, employees, representatives, affiliates, service providers, and agents from and against any claims, demands, actions, damages, fines, penalties, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to the user's use of IndustryNet Connect or any communication made using information accessed through IndustryNet Connect.

To the maximum extent permitted by law, IndustryNet Connect is provided "as is" and "as available," without warranties of any kind. MNI's total liability for any and all claims arising from or relating to IndustryNet Connect shall not exceed the amount paid by the user for the IndustryNet Connect subscription during the three months immediately preceding the event giving rise to the claim.

These IndustryNet Connect Terms of Service are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. MNI may seek injunctive or equitable relief for any unauthorized use of IndustryNet Connect, misuse of IndustryNet data, scraping, automated access, credential sharing, or other conduct that may cause harm to MNI, IndustryNet, suppliers, users, systems, data, or business operations. If any provision of these IndustryNet Connect Terms of Service is found unenforceable, the remaining provisions will remain in full force and effect. These IndustryNet Connect Terms of Service, together with the MNI Terms of Use and any applicable subscription, checkout, or billing terms, constitute the agreement governing use of IndustryNet Connect.
